Terms and Conditions

Ltd. Brūklene Deco, Reg. No. 40203334273, legal address: Tīnūžu shoseja 9 – 3, Ikšķile, Ogres district, LV-5052, hereinafter – the online store – provides the content available on the website and offers goods and services in accordance with the terms and conditions outlined below.

1. General Terms

If the consumer purchases goods/services through the website, such an agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia regulating distance contracts, including but not limited to the "Consumer Rights Protection Law" of the Republic of Latvia, the Cabinet of Ministers regulations "Regulations on Distance Contracts," and other applicable regulations.

2. Making a Purchase

The prices and specifications of the products sold in the online store are listed next to the products.

By entering the necessary information to complete the order, the Buyer confirms that they have read and agree that the provided data will be used by the Seller to accept the Buyer's order and carry out delivery in accordance with the regulatory requirements. By entering this information, the Buyer agrees to receive notifications related to their order via the specified email.

To make a purchase, add the desired products to the shopping cart. Fill in all the required fields and select the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Proceed with payment to complete the order.

The order will be processed within 5-10 working days, depending on the chosen delivery method.

The Seller commits to clearly and transparently display the parameters and specifications of the offered goods.

The Seller has the right to publish images of custom-made products on www.bruklene.com if the Buyer has not made a written or verbal request to refrain from publishing images of the products ordered by the Buyer.

3. Payment Terms

The currency for transactions on the website is euros. Payments can be made using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

Latvian internet banking payments: Swedbank, SEB, Citadele, and Luminor Visa/Mastercard card payments. When using the internet banking payment method, confirm the order and click the “Return to Merchant” button.

Personal data required for payment processing will be provided to the licensed payment institution Maksekeskus AS.

The contract becomes valid once the payment is successfully made to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification.

4. Delivery Terms

Goods are delivered within the territory of Latvia using Omniva parcel terminals and courier services. All fees and taxes required for receiving the shipment at the delivery destination must be covered by the Buyer. Delivery costs will be displayed before the order is confirmed. Purchased goods will be delivered to the Buyer’s specified address within 2-4 working days. In exceptional cases, we have the right to send goods within 45 calendar days, with prior notification to the customer.

5. Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the receipt of the goods. (Depending on the product, the Buyer may not have mandatory withdrawal rights; in such cases, the reason must be clearly stated and explained.) Withdrawal rights do not apply if the Buyer is a legal entity.

To exercise the 14-day withdrawal rights, the goods can only be used for their intended purpose, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are improperly used or damaged due to negligent handling or failure to follow instructions, or if the original packaging is lost or significantly damaged, the online store has the right to reduce the refund according to the reduction in the value of the goods.

To exercise the withdrawal rights, you must submit the withdrawal form, which can be obtained upon request by sending it to info@bruklene.com within 14 days of receiving the goods.

The Buyer is responsible for the return shipping costs, except in cases where the reason for the return is that the product does not correspond to the order (e.g., incorrect or damaged product).

The Buyer must return the goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will refund all payments received from the Buyer within 14 days based on the Distance Contract.

The Seller has the right to withhold the payment until the goods are returned or the Buyer provides proof of the return of the goods. If the Buyer has chosen a delivery method that is more expensive than the cheapest delivery method offered by the online store, the online store is not obliged to compensate for the excess delivery costs.

The online store is not responsible for delays or failure to fulfill obligations due to circumstances beyond its reasonable control.

The online store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price listed on the website is significantly lower than the market price due to an error.

The contract becomes valid once the payment is successfully made to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification.

6. Consumer Rights Regarding Non-conforming Goods

The online store is responsible for the non-conformity of goods sold to the Buyer under the contract or defects that arose within 6 months after the delivery date, or were present at the time of delivery, unless such an assumption contradicts the nature of the goods or defect. The Buyer must inform the Seller about the non-conformity of goods immediately, within 2 months of discovering the defect, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store via email at info@bruklene.com.

The online store is not responsible for defects that arise after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the repair or replacement of the goods free of charge.

If the goods cannot be repaired or replaced, the Seller will refund the Buyer all payments made under the Distance Contract. The Seller will provide a written response to the consumer’s complaint within 15 days.

7. Processing of Buyer’s Personal Data

The online store processes only the personal data provided by the Buyer when placing an order, such as name, surname, email, etc.

The online store provides personal data to the transport service providers to ensure the delivery of goods.

If you have expressly consented to receive marketing communications, including updates, we may occasionally contact you via email about our services and the latest offers. For this purpose, we may process your email address, which you provided when subscribing to marketing communications. The Buyer can opt-out of marketing communications by notifying us at info@bruklene.com.

8. Dispute Resolution

In matters not covered by these terms and conditions, the Buyer and the Seller agree to adhere to the applicable laws of the Republic of Latvia.

Both parties will attempt to resolve any disputes between the Seller and the Buyer through mutual discussions or correspondence. If the dispute cannot be resolved through discussions or correspondence, the parties will resolve the dispute in the courts of the Republic of Latvia, in accordance with Latvian regulations. Disputes between the Buyer (consumer) and the Seller may be submitted to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.

The Buyer also has the right to address disputes to the European Union dispute resolution bodies.
